Terms and conditions

Scope

These terms apply to all offers, quotes and contracts between Forkspare (“we”) and our customers. We supply only to businesses within the meaning of Section 14 of the German Civil Code (entrepreneurs). Sales to consumers are excluded.

Quote and contract

The catalog and website are not binding offers. A contract is formed when you accept our written quote, or when we confirm your order. The quote states the condition of the part, the warranty and the delivery time for each position.

Prices and payment

All prices are net in euros, excluding statutory VAT and shipping costs, unless the quote says otherwise. Payment is made in advance by bank transfer against our invoice. We ship after receipt of payment.

Delivery

Delivery is made directly by one of our supply partners to the delivery address you give. Delivery times in the quote are estimates unless expressly agreed as binding. We provide a tracking number where the carrier offers one.

Condition and warranty

Parts are offered as refurbished, used or new surplus. Refurbished parts are reconditioned and tested by the supplier. Used parts are pre-owned, and their condition is described in the quote. New surplus parts are unused. Warranty terms are stated in the quote. Without a stated warranty, the statutory rights apply, with the limits permitted for business customers.

Compatibility with your truck is your responsibility. Fit always depends on the serial number of the vehicle and its software version. We help you check it on request but do not guarantee it unless confirmed in the quote.

Use and installation

We supply to businesses only. Parts must be installed by qualified personnel. Drive controllers, lift controllers, brakes, steering and other control electronics are safety-relevant: after installation, a function and safety check of the truck is required, and the manufacturer’s instructions and the applicable rules for industrial trucks must be followed. Before ordering, check the fit against the serial number of the vehicle and, for electronics, its software version.

Liability

We are fully liable for intent, gross negligence, injury to life, body or health, and under the Product Liability Act. For slightly negligent breach of an essential contractual obligation, our liability is limited to the foreseeable damage typical for this type of contract. Otherwise liability is excluded as far as legally permitted. This includes liability for production downtime and loss of profit.

Retention of title

Delivered goods remain our property until full payment of the invoice.

Final provisions

German law applies, excluding the UN Convention on Contracts for the International Sale of Goods, as far as legally permitted.
